You are required to draft aDefenceclaim, based on the scenario you just competed in the Plaintiffs claim on for your last assignment.

You will be assessed on being able to correctly draft the Defence. You must determine which of these options are appropriate in your client's case

1.Dispute the entire claim;

2.Admit liability for the claim, make a proposal of terms of payment of the amount claimed; or

3.Admit liability for part of the claim, make a proposal of terms of payment of that part of the claim and defend the remainder of the claim.

You are to draft your Defence using Microsoft word by creating a "Schedule A".Please note that you areNOTrequired to fill out the necessary form from the Small Claims website, simply draft the Defence using the "Schedule A" using the proper style of cause template you were given.

You are to email the completed Defence to YOUR INSTUCTOR within the four-hour time frame allotted for this exam. Failing to send the document within the time allowed you will be given zero marks.

Scenario

Your firm has been retained today April 8, 2020 to represent "Everything You Need Supermarket Inc."company in respect to a few unpaid invoices.A plaintiff's claim was served on the company on April 7, 2020.

According to the area manager, Scott Wild, he has tried to negotiate payment from "Everything You Need Supermarket Inc. ",but so far he has had no luck.

Mr. Wild has indicated that to date, there are a total of 3 invoices which are outstanding, with a total balance owing of $2,887.15. The invoice information is as follows;

Invoice 1 (January 10th2019)

1.15 Bundle of Carrots - $120.00

2.30 Watermelons - $ 200.00

3.80 Bundles of Lettuce - $150.00

4.10 Baskets of Peaches - $250.00

5.60 Lemons - $145.00

Total: $977.45 (Taxes Included)

Invoice 2 (February 4th2019)

1.30 Bags of Potatoes - $215.00

2.20 Bundles of Radishes - $85.00

3.25 Baskets of Apples - $390.00

4.20 Baskets of Grapes - $400.00

Total: $ 1, 231.70 (Including Taxes)

Invoice 3 (March 17th2019)

1.15 Bags of 2% Milk - $130.00

2.15 Bags of 3% Milk - $145.00

3.15 Bags of 1 % Milk - $95.00

4.9 Cartons of Cream - $80.00

5.35 Containers of Sour Cream - $150.00

Total: $678.00 (Including Taxes)

Mr. Wild has indicated that they have never had an issue with this customer in the past and are afraid that the only reason they are withholding the payment is because about a month ago, the owner's son was denied employment by them. Even though Mr. Wild tried to explain to "Ms. Stepherson", the owner of "Everything You Need Supermarket", that he did not think it was in the best interest of business, he is afraid that she is holding a grudge.

It is also important to mention that Mr. Wild expects that interest be applied to the invoices.The invoices stipulate an interest rate of 1% per day for any outstanding balances up to the date the debt is paid off.

Lastly, Mr. Wild wants to ask for costs of the action, along with legal fees.
