You are to read the following scenario and determine what evidence you would seize and why you would seize it. For instance, in an investigation where an accused passed a note to the bank teller during a robbery you would seize the note and have the note examined for the suspect's fingerprints. For the purposes of this case study, I want you to write it in this format:

Seize Note - check for prints and compare with prints of Suspect 1 (if there is only one suspect then you can write suspect).

I want you to list all the evidence that you would seize in this format. In point form, list the article you would seize, what you expect to get (ie. fingerprints) and who is associated with that article (ie suspect #1).I recommend that you read the story first and then read it again listing your evidence. After reading the case, determine all the evidence that you would seize for this investigation.

Scenario:

On Thursday September 10, 2012 the victim and his girlfriend were at Sammy's Billiards Cafe located at 1566 St. Clair Avenue West in the City of Toronto. Also in the cafe at this time were two males playing pool, a waitress and the owner of the Cafe. The two males playing pool, each had a beer and they were drinking from the bottle, and both were smoking. The owner's dog was in the caf and the two men playing pool were playing with the dog

The victim went to the washroom and when he came out of the washroom he saw that his girlfriend was talking with one of the other males. The victim noticed that this male was using his girlfriend's phone. As the victim approached the two males, the one who was using the phone handed it to the victim and the victim gave it to his girlfriend. The victim was upset that the male had approached his girlfriend and asked the suspect what was his problem. The suspect punched the victim and a struggle ensued. The suspect pulled a gun from his pocket and pointed it at the victim. The victim grabbed the suspect's arm and the two wrestled over the gun. The second suspect punched the victim in the back of the head and while the three were fighting, the gun went off and a single bullet struck the bar. No one was hit. After the shot was fired, the two suspects got up and the victim's girlfriend grabbed suspect # 2 but he punched her in the nose, breaking her nose and causing a significant amount of blood spatter. The two suspects fled the cafe and the owner called the Police.

The male with the gun was described as male white, 5'9", 160 lbs wearing blue jeans and a black hoodie. He had no facial hair and was armed with a black gun that the victims described as looking "like the guns that the Police have".

The second male was male white, 5"11" - 6', 190 lbs and had a goatee. He was wearing a Yankees baseball cap.

Police arrived and spoke to the victim and the witnesses. There was a camera inside the cafe however it was not working. They canvassed the area looking to see whether there were any other cameras and one of the officers found a Yankees baseball cap on the sidewalk just east of the cafe.

Both suspects were arrested and are in police custody.
