You are working in Arizona as a contract paralegal for family law attorney Nancy Clawson of Peter, Piper, & Clawson. You've just received the following email from Ms. Clawson: To: p..l@contractwork.com From: n..n@ppclawson.com Dated: January 5, 2020 at 3:42 PM Re: Client Burke's Move to Texas Message: Hello! I consulted with a new client yesterday, Neal Burke, who recently relocated to Texas from Phoenix, Arizona with his two children, 10 year old twin boys. The mother, Ellie Graham, continues to live in Tempe, Arizona. The parties have a current parenting plan from their 2016 divorce in which they share joint legal decision-making and equal parenting time, but their parenting plan does not say anything about relocating the children out of state. About a month before he moved, Mr. Burke sent Ms. Graham an email letting her know that he planned to move to Texas with the boys. She wrote back immediately that she vehemently objected but, confident that he would not be able to leave without her permission, did nothing further. He departed a month later with the kids, knowing Ms. Graham objected but believing that he had the right to go because he warned her in writing and she did nothing to stop him in court. I need you to research our state statutes to determine whether Mr. Burke's conduct was legal. More specifically, if a parent like Mr. Burke is going to move, is there a law on our books that dictates the procedure for the relocation of children? If so, did Mr. Burke correctly follow it? If you could have this back to me in a traditional office memo format by the end of the week, I would greatly appreciate it. Thanks! ~Nancy You are going to research, analyze, and write this office legal memorandum over the course of this lesson and the next.
