You Be the Judge 1 1 . 1 Accord and Satisfaction Miles and Danika entered into a contract. He promised to repair the roof on her house and she promised to drill a well on his farm. Miles immediately executed his side of the bargain by fixing Danika ' s roof. A short time later, Danika discovered that she would not be able to uphold her end of the bargain. Contrary to her assumption, Miles ' s farm sits on top of rock, rather than clay. She simply does not have the equipment required to drill through rock. Miles initially took pity on Danika and generously accepted her offer to " just end this thing. " He now insists, however, that she is liable for breach of contract. Questions for Discussion When the parties promised to end their contract, Miles had fully performed but Danika had not. If Miles wanted out of the original contract, he could say that he bought Danika ' s promise by giving up his right to have a well on his farm.
