Read the "You Be the Judge" on p. 245 of the text. It is the case ofQuake Construction v. American Airlines.

Review the facts, and the arguments of each party in the case.

The issue is:did the letter of intent constitute a valid contract?Review section 10-3. Was there a valid offer and acceptance? Why or why not? Review section 13-1c. Was there a mistake and, if so, what kind?

As the judge, decide for one party or the other. State your reasoning. Try to go beyond reiterating the argument given in the text. Also, don't rely on your instinct. Apply the law.

Note that the dispute is between Quake Construction as the would-be subcontractor and Jones Brothers Construction as the general contractor for American Airlines.
