It also provides that if he leaves the company for any reason he may not work in the IT field for a period of 5 years. All intellectual property produced during his employment shall be the property of his employer. It provides that the list of clients is the property of the employer and may not be used by Steve in the event he leaves employment with the company. A second contract involves the sale of a business by Susan. She is selling her restaurant in Charlottetown and the sale contract provides that she may not operate or be associated with any restaurant in PEI for a period of 15 years. The market for the business is really just the City of Charlottetown. Please provide advice on both of these contracts and indicate which terms are or are not valid and why. Please include and analysis of what effect equality or inequality of bargaining power, has on the formation of contracts.
