You received an email from your supervising attorney asking you to conduct a new client intake for a personal injury lawsuit your firm is considering undertaking. Re:       Potential Client Jessie Rider

Dear Paralegal,

The Justice Firm was recently contacted by Jessie Rider, a passenger on a commercial bus line called Big City Express. Big City Express is a national corporation licensed to do business in your state as well as throughout the United States. Their home office is in Fargo, North Dakota.

On July 4th of last year our potential client was riding from our state capital to Washington, DC to celebrate Independence Day on the National Mall. As the bus was leaving our home state, it was involved in a collision with a moving truck owned by We-Haul-It-All, a locally owned company that rents moving trucks and equipment to people who want to move their homes by themselves. We-Haul-It-All does not operate outside of our home state. The accident caused both vehicles to leave the road and strike an embankment at a high rate of speed, causing a sprained wrist for Ms. Rider, as well as a concussion and other injuries. Both the driver of the bus, Bess Driver, and the driver of the rental truck, Ron Renter, were cited for reckless driving, although neither of those drivers have been to court yet for the tickets.

As you prepare for the intake interview, please email me with suggestions on what we should be looking out for regarding the following questions:

Do we have a choice here between filing in state court or federal court? Explain why or why not.

  • Is it possible there are multiple defendants we could sue in this case? Please identify all possible defendants and the cause of action that we could use to sue each of them.

If you have other concerns you think we should keep an eye on, list them briefly, but don't elaborate on them as this email must be concise and to the point.

 Regards,

Attorney Max Justice

Two weeks have passed since you completed the intake interview. The firm has decided to pursue the litigation only against the driver of the rented moving truck. The driver and Big City Express bus company were found not to be negligent in preliminary investigations. There is also no evidence that the We-Haul-It-All Corporation was negligent in renting the truck to the driver, Ron Renter.

Our office will now prepare discovery requests to submit to Ron Renter as soon as the Complaint has been filed and served. In anticipation of this assignment, please prepare a memo of at least 250 words for the attorney explaining the three types of written discovery available in this case: Interrogatories, Requests for Production, and Admissions.

 The memo should:

  • Explain the different purposes served by each type of written discovery, and
  • Provide at least three examples of each type of question that would enable us to improve our understanding of this case.
