You will be preparing an Interoffice Memorandum to answer a legal query presented regarding a paralegal's ethically-permissible functions. The ONLY authorities you may use are: Attorney Griev. Comm. v. Hallmon, 343 Md. 390, 681 A.2d 510 (1996), In re Morin, 319 Or. 547, 878, P.2d 393 (1994), People v. Milner, 35 P.3d 670 (Colo. 2001), State Stat. 88.120. Remember to apply the IRAC method (Issue, Rule, Analysis, Conclusion) to present the issues. Do each issue separately.
Our client, Susie Bell, was hired three months ago in the role of paralegal. She is concerned about some tasks and duties she may have to perform, some of which she has already engaged in she thinks, in hindsight, may have been inappropriate. The attorney asks that she handle the initial interview when clients first come in order to gather facts as well as inform the client of her specific fees that would be charged including the paralegals and attorney's hourly rates. The attorney will also expect her to review some authorities to decide the case. Additionally, she will want to know whether she can ask her to attend settlement conferences when not in her presence and allowed to accept or reject any potential proposal presented but wants to ensure delegating such tasks would not be unethical.
