Your law firm's client is a property management company, Duncan Properties. Duncan owns and operates a 12-story apartment building, Duncan Manor. They have been sued by Ms. Patel. Patel alleges that on a recent evening, she arrived at Duncan Manor at around 9 o'clock in order to visit her friend, Mr. Russo, a resident who lives on the 12th floor and who had invited Patel to his weekly game night. Patel parked in the Duncan Manor lot, in a marked visitor's parking space. The lot was dimly lit, since several of the lamps in the lot were not operating. Outside the lobby door Patel picked up the telephone intercom system and used it to contact Russo and let him know that she had arrived. Russo told Patel he would buzz her in the door, but when he tried, the intercom buzzer did not work, and the door remained locked. Russo told Patel to wait outside the lobby and he would come downstairs himself and let her in. Before Russo could arrive, however, a man, Cremins, emerged from the shadows and mugged Patel, causing serious physical and psychological injuries.
