Yvonne is the new owner of "Chill Out", an ice cream shop. She purchased Chill Out from Barry and is now looking to get out of the sale.

Before Yvonne entered into the contract to purchase Chill Out, she viewed it several times. The shop was situated next to a local nature reserve. She asked Barry whether Chill Out gained much business from the nature reserve. Barry said "This is a good solid location for an ice cream shop and Chill Out gets much of its business from visitors to the nature reserve". This was technically correct. However, Barry failed to tell Yvonne that the nature reserve had just been declared unsafe for the public and was about to be closed for three years. Barry did not mention this to Yvonne because he did not want to put her off the sale (privately thinking that it was her job to check up anyway). Yvonne had been undecided as to whether to purchase Chill Out or another ice cream shop she had seen, but she purchased Chill Out because of the business she thought she was going to get from visitors to the nature reserve.
