Bob’s Best Bread is a family-owned and operated bakery founded in 1956 by Robert Brecca. It is now managed by Roberta Brecca, Robert’s granddaughter. About half of the company’s 50 employees are members of the Brecca family. The company has no formal sexual harassment program. Every August the company holds a barbecue for employees and their families at the Brecca estate. One of the activities is a “best body” contest held at the pool, where male and female contestants clad only in bathing suits are judged for their pulchritude and musculature. Jim Johnson is a baker at the company and not a member of the Brecca clan. Although he is an excellent baker, he is also known as having a bad attitude and as someone who is often late for work. A few weeks after the barbecue he comes to see Roberta in her office to complain about the best body event. He says that it degrades both women and men, and that people without athletic builds are made to feel ashamed and unappreciated. Roberta thanks him for his feedback and sends an announcement to the employees that the best body event is canceled for next year, to be replaced by a “best dressed” competition. Several months later Roberta fires Jim based on his unacceptable record of tardiness and his “poor attitude” about his job. Jim files a complaint with the EEOC. What result?
