You are general counsel at a mining company. The company experiences a disaster in which three miners are killed in an explosion. During the course of an internal investigation you discover that in the weeks before the accident safety officials had reported dangerously high levels of explosive gas in the mine. Normal procedure would be to cease mining operations while the gas is vented out. However, you discover that the supervisor had overridden these procedures in order to keep production on track to meet an important contract. In your opinion the supervisor’s actions manifested a depraved indifference to human life. Although the mine has been shut since the accident and safe working conditions are being restored, nothing can bring back the dead miners. May you report the supervisor’s misconduct to the Mine Safety and Health Administration?
