Alan’s house was next to a cricket field, which was the property of a cricket club. The members’ children were allowed to play in the field, and many boys gathered there to play cricket every day.

A high fence that surrounded the field overlooked Alan’s house. It often happened that the ball from the boys’ cricket match would cross the fence and land on Alan’s and his neighbor’s properties. Alan had himself been injured a couple of times by such stray balls. When Alan was injured yet another time, he sued the parents of the boys who played cricket in the field.
