Summary judgment for Morgan means that Lemming never gets to leap in front of a jury and make his case. A jury’s job is to judge credibility. Isn’t it possible that a jury would find Lemming utterly trustworthy and Morgan a liar, and thus conclude that the friends had formed a binding agreement?
