The Eirik Raude is one of the largest semi-submersible oil rigs in the world. It is owned by Ocean Rig ASA (OR), a company based in Norway. OR engaged Irving Shipbuilding Inc. (ISI), to do extensive mechanical work on the rig in Halifax. The work was initially expected to cost $60 million, but eventually cost $190 million. Their contract contained a clause requiring arbitration to settle any disputes. Without warning to ISI, OR gave notice that arbitration would be used by OR to recover some of the large cost over-run on the job. These overruns related to ISI’s alleged mismanagement of the project. What are ISI’s options? Must ISI participate in the arbitration process?
