The Parkowner has owned and operated Rancho de Calistoga Mobilehome Park, a 184 space mobile home park in the City of Calistoga since approximately 1977. In 1984, the City adopted the Ordinance, which was amended in 1993 and again in October 2007. The Ordinance authorizes a yearly increase in rent that equals the lesser of (1) 100 percent of the percent change in Consumer Price Index; or (2) 6 percent of the base rent. If a park owner wants to increase the rent above that amount, the Ordinance provides for an administrative process to consider such requests. The Parkowner filed a claim arguing that the rent control ordinance constitutes a taking of his property without just compensation because it takes rental income he had counted on earning.
