N.B. West Contracting Co., Inc., agreed to repave Koedding’s parking lot. When the repaving work was done, Koedding was unsatisfied with the quality of the work. Consequently, he informed West of his intention to bring suit. West told Koedding that the lot would be resealed and that the job would be guaranteed for two years if Koedding agreed not to pursue the lawsuit, which had already commenced. Koedding agreed.
