Michelle and Joseph Ardito owned two horses. At one point in time, both Michelle and Joseph were incapacitated. They agreed to have the horses transferred to the Woodbridge Animal Services Farm. Woodbridge eventually “adopted” out the horses to separate new owners. Woodbridge never attempted to contact either Michele or Joseph prior to the adoptions. Had Woodbridge entered into a bailment agreement, thereby making the municipality liable for the unauthorized disposal of the animals?
