Chase Bank issued a cashier’s check in the amount of $851,552 to Daniela and Bohumil Vanco on June 3, 2016. The Vanco’s deposited the cashier’s check into their Bank of America account. Bank of America presented the check to Chase and Chase paid the amount by transferring funds to Bank of America. 

The check was credited to their account on June 6, 2016. A week later, the Vanco’s transferred most of the amount of the check from their checking account to their savings account at Bank of America. The Vancos subsequently became unable to access their funds as Bank of America had frozen the money held in both accounts.

The Vascos sued Chase under UCC C.L. § 3-411 and § 3-412, alleging that the hold on their accounts was “at the demand of Chase or as a result of information given by Chase to BOA about the Check.” Find and read UCC C.L. § 3-411 (a) and (b) and C.L. § 3-412.
