Evan Parent sued MillerCoors for deceptively marketing its Blue Moon Belgian-style beer in violation of California consumer protection and false advertising laws. Parent argued that MillerCoors was marketing Blue Moon as a “craft beer” produced by Blue Moon Brewing, when in fact it is mass produced by MillerCoors. Parent pointed to the absence of references to MillerCoors on the Blue Moon website and to MillerCoors’ use of its registered trademark “Artfully Crafted” on the label and in advertising. Parent also noted that Blue Moon is sold at a premium price like other craft brews, is stocked by retailers in their craft beer sections, and is listed in the craft beer section on the Miller- Coors website.
