In his divorce decree, Elliot was ordered to pay $102 of his weekly wages of $467.47 from his job at a General Motors plant for child support. Months later, U.S. Life Credit Corporation (USLC) recovered a judgment against Elliot in municipal court. With court approval, USLC then garnished 25 percent of Elliot’s $467.47 per week to pay off the judgment amount. The U.S. Secretary of Labor then filed a lawsuit against the municipal court and USLC contending that the payments to USLC and for child support, taken together, violated the 25 percent of disposable income restriction on garnishments imposed by law.
