James Kreidel was engaged to be married and planned to attend school. He entered into a lease of an apartment from May 1, 1972, to April 30, 1974. Before the lease period began, Kreidel’s engagement was broken. As a student, Kreidel then had no means of support and therefore had no way to pay the rent. On May 19, 1972, he wrote the landlord explaining his situation and stating that he was abandoning the lease. Although the landlord had the opportunity, he did not rerent the apartment until September 1, 1973. Is James liable for the rent from May 1, 1972, to September 1, 1973? Sommer v.
