1- A vacant field behind the Common Ground subdivision was used openly for gardening by Greta for over 20 years and Piper, the property owner made no effort to claim his ownership of the land. After 20 years, Greta, who had been growing crops on the property and keeping all the profits from her garden sales, filed a claim for adverse possession. Piper's son, Peter dislikes Greta and decides to contest Greta's claim.What arguments can be advanced by each side? Who prevails, and why? 2- At the company holiday party, Polly's supervisor, Fitz has way too much to drink. Fitz stumbles over to Polly and says to her, "Polly, do you know how beautiful you are? Next week I plan on showing you my appreciation for all the work you have done, and the tremendous joy you bring me by just looking at you! Why don't you let me drive you home tonight?" On Monday when everyone returns to work, Fitz acts as though nothing happened, and does not recall his actions. 3- Ken is an auctioneer. He frequently visits the homes of customers to discuss the details of a planned auction. On one such visit, Ken notices a tarp over something large in a corner and asks about it. Ms. Clairmont, the widow of the car owner removes the tarp. Ken is shocked to find a mint condition car some eighty years old. The vehicle has just 100 miles on the odometer. Ken asks Ms. Clairmont if she is willing to sell. She says, no thanks. Ken calls her several times a day over the next few months. Ken reminds her that before her husband died, her husband started the car once a month and only drove it up and down the driveway. On further examination, the original bill of sale was found in the car's glovebox. When purchased, it cost $450. Ken offers Ms. Clairmont $400 because he says, "this old thing is used and abused. Since you guys adopted an Amish lifestyle decades before and had given up motorized transportation, you should pay me to take it away!" She looks at him in earnest and agrees to sell it to Ken for $400. Ken then sells the car on Carvana for $25,000. When Ms. Clairmont's son, Clark comes to move her belongings, he asks his mother about the car and learns of the sale to Ken. Clark sues Ken. Under what theories can Clark sue?
