1. Andy buys a new jet-ski from the local Kawaskai dealership. Andy takes the jet-ski home with him. The next day, during Andy's first use of the jet-ski, it breaks down almost immediately in the middle of the bay. Andy returns the jet-ski to the dealer and demands his money back. The dealer refuses to refund his money, claiming that he has accepted the jet-ski and thus is liable to pay the purchase price. Has Andy accepted? Andy hasn't accepted the new jet-ski from the local Kawaskai. Under the UCC 2-606, What Constitutes Acceptance of Goods, "(1) Acceptance of goods occurs when the buyer (a) after a reasonable opportunity to inspect the goods signifies to the seller that the goods are conforming or that he will take or retain them in spite of their non- conformity." In this case, Andy did not have a chance to inspect the new jet-ski sold by the local Kawaskai until he first used it at the bay. Acceptance of goods does not occur until the buyer has reasonable time to inspect the goods and justify that the goods are conforming
