1. In 2001, Julio, Mark, Tim and Paula were foreign students at the University of Wonderland. They purchased a house Pleasant Castle jointly and this was clearly stated in the conveyance.

Later that year Julio who had to leave the University for failing several courses sold his interest to Nicole, a fellow student.

Paula married her high school sweetheart and made a will devising her interest in Pleasant Castle to him. She died in a car accident soon after their honeymoon.

Mark and Tim quarreled and Mark acting on the advice of his solicitor commenced proceedings for orders in relation to the property.

Tim wishes to have the property partitioned but the others do not agree to the proposal and Nicole is requesting that they buy her share. Paula's husband wishes to have her interest transferred to him.
