1. Three weeks ago, you listed a luxury property which has been heavily marketed via professional photography including video, several websites, social media and printed media such as papers and magazines. The Office Manager has informed you that the vendor hasn't paid any of their contribution and asks you follow this up as a matter of priority.
You go to the file and discover your oversight - you did not have the vendors sign off on the Marketing Plan, nor was it attached to the listing agreement, although you have written 'see attached marketing plan' at both the 'reimbursement of fees - when and how' and the 'property to be advertised / marketed' section.
You have just now called the vendors asking for payment and they refuse, stating that they didn't sign anything which makes them responsible for payment and you have mislead them into thinking the commission was inclusive of marketing.
What do you do and why, quoting any relevant legislation?
2. Your landlord has given you a number of units to lease in the same block. The lowest priced one has been successfully leased but the landlord doesn't want the cost of a new signboard (which shows 'units starting from $...).
What do you do (bearing in mind legislative requirements) and why?
3. You have been marketing a luxury property for three weeks but have received very little response. Your vendor only agreed to partially fund the advertising and this has already been exhausted. You need to approach them for more investment to the advertising.
Compile an email, providing your reasons why they should contribute.
4. What is the best way to prepare and respond to buyer's enquiries on the day of the auction?
5. On behalf of the landlord you have given the long term tenant 30 days to terminate the tenancy at the end of the fixed term. The tenants have been excellent up until now, however, their direct payments have ceased and they are not responding to emails, sms or phone calls.
You attended an outgoing inspection with the tenants and found that there was damage to the garage door. They say it was caused by the removalists, which is the tenant's responsibility as they employed them. Everything else was in excellent condition. It is now five days later, the door has not been repaired but you are notified by the Bond Board that the tenant has lodged a claim for their bond to be returned.
Task 1
Compile an email to the tenants explaining to them that they have not yet repaired the door and they need to repair the garage door in the first instance, otherwise the landlord will dispute the claim.
Ensure you reference your state's bond rental authority processes in the email.
6. ask 2
The tenants have only occupied the property for the past four months but are now 18 days in arrears. Originally they nominated a bank account for direct debit but that has now been closed. In In addition to this you carried out a periodic inspection two weeks ago where you found the property had some cleanliness issues (eg. greasy stove & exhaust). You arranged to re-inspect after cleaning but when you arrived for your designated appointment the tenants were not at home and have installed new deadlocks to which you do not have a key for access.
a) What would you do according to the legislation and office policy & procedure?
b) Compile an email to these tenants based on your answer above.
c) Compile an email to your landlord based on the above scenario and your expected outcome.
