The accused in a criminal case is entitled to a fair trial. Sometimes, however, these rights come into question because of competing interests. As part of the right to a fair trial, the accused is entitled to cross-examine the Crown's witnesses so that he/she can observe their facial expressions, body language, and demeanour in order to assess their credibility. In one case in Ontario, a Muslim woman wearing a niqab (a face veil covering the entire face except for the eyes, mostly worn for religious purposes) was testifying as a witness in a sexual assault case. The accused argued that the witness's failure to remove her niqab violated his rights to a fair trial because he couldn't assess her credibility. What do you think should happen in cases like these? Young offenders people between the ages of 12 and 18 who are arrested in Canada receive special rights and protections that are not given to people over the age of 18.
