ASSIGNMENT

QUESTION: Mr. \& Mrs. Bogus had previously purchased a holiday package from \( \mathrm{ABC} \) holidays, to \( \mathrm{Nepal} \) from the 1st of September 2022 to the 15th of September 2022. The package included air fare, hotel stay and all 3 meals per day over the course of the holiday. They purchased the package for RM25, 000 of which they have paid a sum of \( \mathrm{RM} 10,000 \) when they booked on the 1st of September 2021. On the 30th of November 2021, ABC holidays General Manager informed Mr. \& Mrs. Bogus that all travel to Nepal have been indefinitely postponed and that they shall update all customers by the 1st of September \( 2022 . \) The couple are furious, disappointed and want to claim a refund of their booking fee paid of RM10, 000. The General Manager has replied to their letters stating that the postponement is not their fault but imposed by the Government. Therefore they had no part to play and in all honesty wanted to carry out their obligations by carrying out the holiday packages as promised.
