10)

Adam offers to sell his mountain bike to his friend Steven on May 15, 2021. Adam says to Steven, I offer to sell my mountain bike to you for $2500.00.

Steven says, Wow that is a great offer. I really like your mountain bike. I am not sure if I can afford to pay $2500.00. Would you give me 3 days to think about the offer and then I will let you know if I can afford to purchase the mountain bike?

Adam says "Sure, no problem. I will give you 3 days to think about the offer."

Two days later, on May 17, 2021, Adam calls Steven to let Steven know that Adam is withdrawing his offer to sell the bike to Steven.

Steven is upset and reminds Adam that Adam promised to give Steven 3 days to think about the offer. Steven told Adam that he was going to call Adam by the next day and ACCEPT the offer.

Adam says that he doesn't care about promising to give Steven 3 days to think about the offer and he is NO longer selling his mountain bike.

Steven says he is going to sue Adam in Court and Adam hangs up the phone.

WHICH IS ENTIRELY TRUE:

A)Adam is the OFFEROR. Steven is the OFFEREE. Adam agreed to give Steven 3 days to think about the offer. Adam violated his agreement with Steven to give Steven 3 days to think about the offer. Thus, Steven could likely successfully sue Adam in Court for the value of the mountain bike and/or to enforce Adam selling his mountain bike to Steven because Steven planned to agree to buy the mountain bike within the 3 days Adam promised Steven to think about the offer.

B)Adam is the OFFEROR. When Steven requested that Adam give Steven 3 days to think about the offer, and Adam agreed, Steven became the OFFEROR and Adam became the OFFEREE and the 3-day agreement is a VALID contract.

C)Adam is the OFFEROR and Steven is the OFFEREE. Adam is not legally liable for failing to give Steven 3 days to think about the Offer.

D)None of the above
