11. Plaintiff was a passenger on a bus operated by Big Dog. Co. The bus collided with a highway bridge, injuring many of the bus passengers. Plaintiff hired an attorney. who sent one of her investigators to the hospital where Big Dog's bus driver was receiving treatment. The investigator took copious notes concerning the accident. Unfortunately, the bus driver died. Plaintiff has sued Big Dog, Co. in federal district court; subject matter jurisdiction is based on diversity. Blg Dog's attorney has sought the notes in discovery. but Plaintiff's lawyer has refused to hand over the notes. Big Dog's attorney met and conferred unsuccessfully with Plaintiff's attorney to try to resolve their dispute. Big Dog's attorney has now moved to compel Plaintiff to hand over the notes of the interview. How should the court rule on the motion? A Deny the motion because. under the rules of evidence. they are inadmissible at trial. B. Deny the motion because the notes are protected by the attorney- client privilege because they were obviously necessary for Plaintiff's attorney to offer legal advice. C. Grant the motion because the notes are obviously with the scope of discovery under Rule 26(b)(1). D. Grant the motion if any mental impressions can be redacted
