1Lisa and Alice went to a night safari park. They were injured when the tram they were travelling in fell into a pond. The tram was drivenbyTommy - an employeeof thesafari park.Lisa died and Alice was paralysed from the neck downwards. Alice also lost her antique watch that she had left in the toiletbefore the accident.
The night safari park denied liability because the following clause was printed on the back of the entrance ticket:
"The Night Safari Park as the occupier of the premises will not be responsible for any loss or damage to personal belongings. Nor will the Park be responsible for the death or personal injury of any visitors howsoever caused."
Alice never saw the clause on the ticket, but the sales assistant did her attention to the clause after she had paid for the tickets. There was also a sign in the toilet that displayed the above clause.
Advise Lisa and Alice.
