Working off one of the cases in your book, if a person takes a sleep medication prescribed by his doctor in accordance with the FDA and the person unknowingly drives while under the influence of the medication and accidentally kills someone while driving, do you charge the driver with vehicular homicide or another crime? If not, who is responsible for his actions (if anyone)? Does it matter that this had never happened in clinical trials of the drug?
