1.Shakespeare leased property to Sinclair Refining

Company for a term of five years at a rental of $5,000 per month. Thirty-three days before the end of the term, Sinclair notified Shakespeare that it would be vacating the premises; but Sinclair did not actually move until four months after the end of the term. Sinclair claims that it is liable only for four months' rent since the original lease called for a monthly rental. Shakespeare claims that Sinclair is liable for an additional five years' rent as a holdover tenant. Who is correct? Why?
