Non-Competition.You covenant and agree that, during the term of your employment with the Company and for thirty-six (36) months after the termination thereof, regardless of the reason for the employment termination, you will not, directly or indirectly, anywhere in Connecticut, Massachusetts, or New York, on behalf of any Competitive Business perform the same or substantially the same Job Duties.

You are fired by the company and decide to take employment with a healthcare company in Massachusetts. Your prior employer sues to enforce the non-compete agreement. Is the non-compete enforceable?
