1.Zainab is a sales agent of a developer company for the housing project known as Gembira Height. On 17 September 2019, Karim bought a bungalow in Gembira Height from Zainab. When he asked about the security of the neighbourhood, Zainab assured him that the house is a gated and guarded community so he should not worry about the neighbourhood's safety. He signed the sales and purchase contract and paid the 10% deposit. A week after he entered the contract, Karim found that there were no security services provided at Gembira Height as represented by Zainab. Karim intends to rescind the sale and purchase contract which he entered with Zainab on the ground of misrepresentation because there were many theft cases at Gembira Height since he lived there. He does not feel safe living there. On the other hand, Zainab argued that during that time, she was only stating her views.
I was confuse with fraudulent misrepresetation and negligent misrepresentation as the sales agent assured that the house is gated and guared, does it mean the sales agent is truely believe it does or she just assured without finding out gate and guard is exist? or even she is knew it as at last she claim herself as she just giving opinion?
Hence, what will be the advice i can give to Karim?
