21) Jasmine wanted to send her expensive satin in dress for dry cleaning to "Cleanever" dry cleaning shop which was located at Adelphi Building. She liked this satin dress as it brought lots of good memory. The dress was also designed by a famous designer and it was her prized possession. She treasured it and it was of sentimental value. She entered the shop and handed over the satin dress to the shop assistant for dry cleaning. The shop assistant handed over a receipt after she had paid the charges for the dry-cleaning service with the collection date written on the front of the receipt. Behind the receipt the following statement was printed. IMPORTANT The owners and management of "Cleanever" accept no responsibility for any loss or damage suffered by a person who uses its laundering services, regardless how such loss or damage is caused, whether by any act, omission, negligence or otherwise on the part of the owners, management or their employees and agents. Since this statement was printed behind the receipt, she did not read the notice. Jasmine returns to the dry-cleaning shop to collect her satin dress and to her horror there were many stains and a big hole. She approached the shop for an explanation, and they point to the exclusion clause behind the receipt and claimed they were not liable for any damages. Jasmine wants to sue "Cleanever" for the breach of contract and obtain compensation for the damage. Advise Jasmine if she will succeed in her claim against the "Cleanever".
