2IntroductionSchlesinger v. United States occurred in May of 2006. Nat Schlesinger and his brother Jack Schlesinger own a clothing factory in Brooklyn, New York. Nat Schlesinger was convicted of multiple violations of the law as well as arson in connection with a fire at the clothing factory on December 31, 1998. The fire investigators, Investigator Thomas J. Russo and Fire Marshall Bernard Santangelo, conducted their investigation and concluded that the fire began, or originated, on the third floor of the building, located in the shipping area. After determining the origin of the fire, the search for the cause began. According to Investigator Russo's on-scene inspection of the building and area of origin, there were no appliances, candles, machinery, chemicals, smoking material, or heating units in the area of origin (Schlesinger v. United States, 2012). The building was found to be secured as well, and this was confirmed by the initial arriving Fire Department units, who stated they had to force entry on all the locksin the building. Assisting with the investigation, Investigator Russo hired an electrical engineer, James Pryor, to examine the electrical system in the area of origin, this included the breaker panel that serviced the area, as well as the wiring to and lighting around the area of origin. James Pryor determined that there were no electrical causes for this fire. Smoking was also ruled out as an ignition source due to the interviews conducted with employees stating that nobody was observed smoking on the third floor and it was not allowed in the building. And lastly Investigator Russo stated that there were no oily rags, incense, candles, or cleaning agents in the area. Investigator Russo was able to make the conclusions on all these sources as potential ignitions sources, due to the investigation by James Pryor on the electrical systems, he was able to rule out cigarette's being an ignition source through the combination of interviews that stated no smoking on the third floor and lack of evidence of cigarette smoking in the area as well as the timing of the final person that was witnessed exiting the building did not correlate to the time the fire was reported to support that a cigarette was the cause of the fire. Investigator Russo was also able to rule out, through his research, that 3Acts of God such as earthquakes, or thunderstorms did not occur during the time prior or during the fire. Investigator Russo found four roof covered heaters in the area and was able to determine that they were not a source due to the lack of flame impingement or additional heat source developing from the heaters
