3. Burt, sixteen years old, purchased a car from West. The purchase price of $1,000 was paid, and the car delivered. West learned that Burt was a minor, tendered the price, and demanded the return of the car. Instead, Burt gave West a statement in writing, signed and sealed; to the effect that he ratified the contract. A few days later the car was stolen. A few weeks after this Burt became of age and immediately notified West that he had decided to disaffirm the contract. Is West bound to return the $1,000? 4. Plaintiff sold and delivered to defendant a boat for a contract price of $1200, to be paid to monthly installments of $100.00. At the time of the sale, defendant represented that she was twenty years of age, although, as a matter of fact, she was seventeen years and ten months old. Defendant, after paying $400 on account in four equal monthly installments, refuses to pay further installments. At that time the boat has depreciated $500 through use.
