$3.$ Jamar, a darker skinned African American employee and Rosa, a darker skinned Hispanic employee have brought a discrimination suit against FTI because they have been continually denied promotions, despite having much better sales performance than other white and lighter skinned salespeople in their department. Their supervisor Toni, is a light$-$skinned African American, and she has told both Jamar and Rosa that she will not promote them because their skin is too dark. She has also made jokes and derogatory comments about their skin color and sent them offensive emojis attached to some of her messages to them. When they have confronted Toni about her discriminatory treatment towards them, Toni has argued that since she is African American herself and a minority employee, she cannot be guilty of discriminatory treatment towards a fellow minority worker.
