Nooreen took the oven back to the shop and demanded a refund of her money from Johan. Johan informed her that she should complain to the manufacturer as the shop was not responsible for a manufacturing fault. After Nooreen had left the shop, Johan looked at the condition of sale made by the manufacturers to retailers and to which he had agreed when he had ordered the oven from them. He discovered that the agreement included a clause which excluded the manufacturers from liability for any express or implied conditions or warranties concerning the quality and fitness of the oven supplied to him.
