5. Article 1734 of the Civil Code of the Philippines states that common carriers are responsible for the loss, destruction, or deterioration of the goods. The object of A which was ordered to be confiscated through a valid search warrant while in transit should be accounted for by the common carrier to A. 92 6. The common carrier is regarded to some extent as a public servant since he holds himself as ready to engage in the transportation of goods for hire as a public employment, and not as a casual occupation. He is bound to serve all who apply, and is liable for refusal, with sufficient reason to do so
