[7] The complainant stated that she was diagnosed with depression and aroiety, and that she has been on sick leave since December 2019. The
complainant stased further that in January 2020, the respondent emailed her to the etlect that she is no longer an employee of the respondent because her
contract ended in December 2019.
[8] The complainant provided a medical note dated January 17,2023, which states that the complainant's depression and arciety were exacerbated by
the work conditions at the Library.
[9] The respondent denied the allegasions in the Complaint and stated that, on December 11,2019, they informed the complainant that they planned to
offer her a fall-year contract or possibly permanent employment with a pay raise. The respondent requested the complainant to confirm the contract
extension affer December 31, but the complainant did not respond.
[10] The respondent stabed that, while the complainant was on medical leave of absence, if issued a Record of Employment to the complainant on
January 6.2020, so than the complainant can access employment insurance benefis.
[11] The respondent stated that in May 2020, the comptainant asked the respondent to terminate her employment, but the respondent refused to
ferminate her employment. The respondent stated further that the complainant remains their employee and that they accommodated the complainant, but
the complainant did not cooperate in the accommodation process.
[12] The respondent stated that on April 24,2020, they wrote to the complainant's physician requesting information about the complainants medical
restrictions and ability to retum to work on mosified dutiess. However, the intormation was not provided by the complainant's physician.
