9:38 1 5G Individual Assignment CO5119 Question 1 Luke is keen to purchase a new robotic vacuum cleaner. He hopes to minimise conflicts with his wife Meghan this way as they both are not keen on household chores. He is willing to try out a new type of smart vacuum cleaner known as the Relationship Saver ("RS") from Happy Homes Pty Lid ("HH"). The RS is advertised as the intelligent vacuum cleaner that utilises built in sensors to autonomously navigate around the home and that can remove 99.99% of bacteria. It is powered by solar and as such it can recharge on its own when exposed to direct sunlight. The RS claims to be the handy solution to time poor households if the removable dust bag is emptied in accordance with the printed instructions provided with every RS purchase. HH sells the RS through its physical shop premises located at Milton Road in Brisbane. The RS is advertised for sale at the retail price of $2000 per unit. The instructions on when to empty the removable dust bag stipulate that the bag must always be emptied as soon as the bag is full of dust. Failure to do so will cause the RS to overheat and ultimately breakdown. He purchases one RS unit from HH at the recommended retail price of $2000. When he returns home, he immediately removes the instructions from the package without reading them. He then proceeds to activate the RS and leaves it to do what it is designed to do. As Luke and Meghan have not vacuumed their floor for a year now due to their aversion to housework, a significant amount of dust has accumulated on the floor. On the very next day, he discovers that the RS has malfunctioned. Upon further examination he finds that the dust bag in the RS is so full of dust that it has caused the device to overheat and is now damaged beyond repair. He thought he knew what he was doing and as such, did not find it necessary to read the instructions at the relevant time. Luke seeks assistance from HH for the RS to be replaced or his money refunded. Nathan the salesperson at HH who sold him the machine apologises and says 'As you did not follow the instructions, regrettably we are unable to replace or refund you the money for the goods purchased.' REQUIRED Advise Luke of his rights to get the RS replaced and/or money refunded under the Australian Consumer Law.
