A. Asante has invented a new type of computer chip, which works in a different and inventive way compared with prior art chips, and Asante has also invented a new process which will be used for making those chips. He has taken out patents for the process and for the chips. Baffour finds out about the process and decides to build a similar process for making these computer chips. Baffour asks Chalie to supply equipment that is essential to the process. Baffour then makes some computer chips and sells them to Dangote, a trade supplier. B. Darko is a computer programmer and is employed by a software development company known as SofTribe Ltd. A retail organization known as Kunte Trading Ltd asked SofTribe to write some computer software to handle Kuntes accounts and paid SofTribe a fee of GH87,500 for the work. All the work was carried out by Darko at Kuntes premises and on Kuntes computer during a period of 10 months. Darko was paid an hourly rate (GH17.25 per hour) by SofTribe for his work on the project. There is nothing in writing to say who owns the copyright subsisting in the computer software and no assignment of copyright.
