This morning the worker notes there is an unusual amount of travel in the brake pedal and the pedal feels "mushy". Being a conscientious employee, the worker advises the supervisor. The supervisor instructs him to use the truck and he'll have the mechanics look at it at the end of the shift. Being concerned, the worker refuses to use the truck citing it is unsafe. The supervisor says, "fine, take another truck." He then assigns the first truck to another worker who doesn't complete his circle check and takes the truck out onto the road. The brakes fail and the truck rear-ends a car injuring the worker and a member of the public. Was the worker within his rights to refuse to drive the truck? Why or why not?
