a) The house has an underground wine cellar. Your client furnished the cellar with

antique furniture. A few months after taking occupation, there was a huge

rainstorm. Your client goes into the cellar two days after the rainstorm and sees

that all the antique furniture is floating around in water. Your client contacts the

seller and the seller says that he is not aware of any water problems and that in

any event the sale is voetstoots and that he is not responsible for any damage

caused.

Your client takes the furniture to an antique furniture restorer and tells the

restorer how the furniture got damaged. The restorer tells your client that he (the

restorer) had another client that had a similar problem. After talking to the

restorer, your client realizes that the person they are talking about is the seller

that he bought the house from. Your client tells you that he has heard that the

provisions of the Consumer Protection Act have amended the common law rules

regarding voetstoots sales.
