A female employee, on an out-of-town business trip with her male supervisor, was working on a project in is hotel room late at night when he made sexual advances toward her. She successfully rebuffed him, left his room immediately and reported the incident to the company the next day. The supervisor was reprimanded and no other incidents occurred until another business trip six months later. At that time, following a day of conference meetings, the employee accepted her supervisor's invitation to go "bar-hopping". Afterwards, around midnight, he invited her to his room to talk, and assured her that his intentions were innocent. She agreed on those terms, but once she was in his room, he made sexual advances toward her by trying to kiss her. She rejected and left the room. Later, she filed a sexual harassment claim against the employer. Who prevails, and why?
