A few weeks ago, Jorge was shopping at the local mega-mall on a busy Saturday and stopped to check out the cell phones at "Great Buy", the electronics store. He checked out several phones on display, made some mental notes about the pros and cons of "upgrading" his current device and decide to leave the store.
Unfortunately, when Jorge headed for the exit an item in his shopping bag set off a security sensor. He was asked to remain in the store by Vladdy, a uniformed security officer employed by Great Buy, until the police arrived.
Jorge was escorted by Vladdy and a Great Buy sales associate, Aniya, to a storage room behind the customer service desk. He was held there for over an hour, as Vladdy kept watch just outside the locked door. Eventually, a police officer arrived at the store and after interviewing both Jorge and the store personnel, determined that there was no reason to detain Jorge any longer.
Jorge quickly left the store but was understandably upset. Being treated "like a criminal" by the store had been embarrassing for him. He is worried about his reputation and since the incident, he has been reluctant to leave his house, even for social engagements.
He would like to retain a lawyer and commence a lawsuit, alleging that he was falsely imprisoned at Great Buy.
1) dows great buy have a legal problem here? Why or why not
2) What are Jorges damages? Who would have to pay up if his claim is successful? Vladdy? Aniya? Great buy?
