A university operated a tavern on its premises for the benefit of its students. A student, who attended the tavern with some friends in order to celebrate the end of the fall semester, became quite drunk. The bartenders at the tavern realized that the student was drunk around 11:00 pm and refused to serve him any more alcoholic beverages. They also asked him to leave the premises. The student, however, stayed and drank two additional beers that his friends bought him. Some time later, around 12 a.m., one of the bartenders noticed the student drinking and instructed the tavern bouncer to ask the student to leave. The doorman did so, but the student refused, and the doorman took him by the arm and walked him to the door. Along the hallway to the door, the student abused and resisted leaving, but the doorman managed to expel him from the building. Minutes later, the student returned to the tavern and slipped next to the doorman for the supposed purpose of obtaining an explanation as to why he had been expelled. About eight feet from the door, he was seized by the bouncer and again expelled from the tavern, but not without some resistance in the form of pushing and abusive language on the part of the student. In the course of the ejection, the student fell against the door and broke a glass panel in the door, causing severe lacerations to his hand. The injury to the student's hand required medical treatment and it took him several months to heal. The student brought an action against the university and the janitor, claiming damages and also alleging that the injury he received caused him to fail his mathematics course in the semester following the accident. He will discuss the issues raised in this case and the various arguments that each side could present. Give a decision.
