Able negligently rear-ends Baker's car. The impact is very slight and there is relatively little damage to either car. Unfortunately, Baker suffered from a rare bone disease and the impact caused him to break his neck and become paralyzed. In the resulting lawsuit, Able: will likely be successful in arguing that he could not have reasonably foreseen Baker's rare bone disease will likely lose the case and be fully liable for all of Baker's injuries as the defendant takes the victim as he is found may likely lose the case, but will argue the doctrine of "exposos non reasonableness" in an effort to have Baker's damages capped none of the above
